Establishment of Hospital Receivership Emergency Act of 2007 |

On July 10, 2007, the Council approved the Establishment of Hospital Receivership Emergency Act of 2007. Introduced by Councilmember Catania, this legislation grants the Mayor authority to seek the appointment of an independent receiver to operate a hospital under certain circumstances, including if an emergency exists that threatens the health, security or welfare of patients.
Similar to legislation enacted in at least 15 other states, the bill also establishes the specific powers and duties of a receiver, permits a receiver to use hospital revenues during the term of appointment, and sets forth the conditions of termination of a receivership.
