Washington, D.C. - Councilmembers David Catania (At-Large) and Harold Brazil (At-Large) introduced legislation June 29, 2004, that increases the penalties associated with unauthorized use of a motor vehicle. Both Councilmembers believe this measure will deter habitual car thieves by promising harsher punishment for such action.
Catania commented, "These offenders know they won't be punished with any serious fine or time. The current method of coloring books and sensitivity training has done nothing to prevent recidivism." Despite the fact that cars are being stolen at an alarming rate throughout the District, and especially east of the river, prosecutors rarely seek to charge individuals with actually stealing vehicles. Offenders are instead accused of "unauthorized use of a motor vehicle", a much easier charge to prove, but one with inconsequential penalties. The "Increased Penalties for Unauthorized Use of a Motor Vehicle Act of 2004," increases the minimum penalty for such an offense from $1,000 to $5,000 and/or up to 5 years in prison. The bill prescribes a fine between $1,000 and $10,000 and at least 3 months in prison for any subsequent offense. "It's time we begin to treat this problem of 'unauthorized use of a motor vehicle' as a serious crime," said Brazil. "The irresponsible and illegal behavior that is occurring in our neighborhoods and communities is threatening the public safety of our residents, and cannot be tolerated."
